Acceptable Use Policy

This Acceptable Use Policy protects ClearConverse customers, networks, and the public communications system. By using our Service, you agree to these rules.

This Acceptable Use Policy ("AUP") is part of your agreement with ClearConverse Corporation ("ClearConverse," "we," "us," or "our") and applies to all use of our websites, hosted voice, messaging, fax, AI agent, unified communications services, and the CrystalQore platform (collectively, the "Service").

The AUP is incorporated into our Terms of Service. Violations may result in suspension, termination, or other enforcement action. If you do not agree with this policy, you must not use the Service.

1. Purpose & Scope

This AUP protects ClearConverse customers, our infrastructure, carrier and messaging partners, and the public telephone and messaging networks. It applies to all account holders, users, administrators, and anyone who accesses the Service through your organization.

You are responsible for ensuring that all users under your account comply with this AUP and with applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM, CAN-SPAM equivalents, state recording consent laws, and industry carrier guidelines.

2. Prohibited Activities

You agree not to use ClearConverse to:

  • Violate any applicable law, regulation, or third-party rights
  • Transmit spam, unsolicited communications, robocalls, or robomessages in violation of TCPA or similar laws
  • Distribute malware, viruses, ransomware, or other harmful code
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Interfere with or disrupt the integrity or performance of the Service
  • Harvest, scrape, or collect data from other users without consent
  • Impersonate any person or entity, or misrepresent your affiliation
  • Use the Service for any illegal, fraudulent, or deceptive purpose
  • Engage in activities that generate excessive load intended to degrade service quality
  • Circumvent any rate limits, security measures, registration requirements, or access controls
  • Harass, threaten, abuse, or defame any person or organization
  • Facilitate child sexual exploitation material, human trafficking, or other serious crimes

3. Voice & Calling Compliance

When using ClearConverse voice services (including Cloud PBX, SIP connectivity, and CrystalQore calling), you agree to:

  • Obtain all required consents before placing autodialed, prerecorded, or artificial-voice calls
  • Honor Do Not Call (DNC) lists and opt-out requests promptly
  • Not engage in caller ID spoofing with intent to defraud, cause harm, or wrongfully obtain anything of value
  • Provide accurate caller identification where required by law or carrier policy
  • Comply with recording and monitoring consent laws in all applicable jurisdictions before recording calls
  • Not use auto-dialers or predictive dialers in a manner that violates applicable law
  • Not place calls for unlawful debt collection practices, illegal gambling, or fraud schemes

ClearConverse may require campaign registration, volume thresholds, or additional documentation for high-volume outbound calling. Failure to register or comply may result in traffic blocking.

4. Messaging & SMS Compliance

Customers sending SMS, MMS, or similar messages through ClearConverse must:

  • Obtain express consent (or the legally required form of consent) before sending commercial or telemarketing messages
  • Clearly identify the message sender and provide a simple opt-out mechanism
  • Honor opt-out requests promptly and cease further messaging as required by law
  • Maintain records of consent and opt-outs as required by applicable law and carrier guidelines
  • Not send deceptive, fraudulent, or phishing messages
  • Not send adult content, controlled-substance promotions, or other prohibited content categories under carrier or aggregator policies
  • Register campaigns and brands as required for high-volume or application-to-person (A2P) messaging

ClearConverse may require 10DLC, toll-free, or short-code registration before enabling messaging traffic. Messages that violate carrier filters or this AUP may be blocked without notice.

5. Fax Use

When using ClearConverse eFAX or fax services, you agree not to:

  • Send unsolicited fax advertisements in violation of applicable law
  • Transmit illegal, harmful, or rights-infringing content
  • Use fax services to harass recipients or flood networks with junk transmissions

6. Network & System Integrity

You may not:

  • Probe, scan, or test the vulnerability of ClearConverse systems without prior written authorization
  • Interfere with DNS, SIP signaling, media streams, or other network protocols used by the Service
  • Introduce traffic intended to overload, crash, or degrade carrier or ClearConverse infrastructure
  • Resell or redistribute Service capacity in a manner that violates your agreement or this AUP
  • Use bots, scripts, or automated tools to abuse APIs, webhooks, or admin interfaces beyond documented rate limits

7. Identity, Spoofing & Misrepresentation

You must not:

  • Falsify, obscure, or manipulate origination information for calls, messages, or faxes
  • Impersonate ClearConverse, carriers, government entities, banks, or other organizations
  • Use numbers you do not have the right to use
  • Misrepresent the purpose of a campaign during registration or review

8. Fair Use & Resource Limits

ClearConverse services are intended for ordinary business communications. We may apply fair-use policies, concurrent call limits, messaging rate limits, and storage caps as described in your plan or order form.

Activities that generate unusually high volume, sustained saturation of trunks or queues, or patterns consistent with spam or abuse may be throttled, queued, or suspended pending review - even if not expressly listed above.

9. Customer Responsibilities

  • Secure credentials and limit admin access to authorized personnel
  • Configure emergency calling and location data where required for your use of voice services
  • Ensure downstream users, vendors, and partners comply with this AUP when they use your ClearConverse environment
  • Respond promptly to abuse complaints and compliance requests from ClearConverse
  • Maintain any licenses, registrations, or consents required for your industry and campaigns

10. Enforcement

We reserve the right to investigate suspected violations. Depending on severity and history, we may take one or more of the following actions:

  • Issue a warning and require remediation
  • Temporarily throttle or block specific numbers, campaigns, or traffic types
  • Suspend part or all of your account
  • Terminate your account and refuse future service
  • Report serious violations to law enforcement or regulators
  • Cooperate with carriers, aggregators, and lawful requests from authorities

ClearConverse is not obligated to monitor all content but may review traffic patterns, messaging content samples, and registration data as needed to enforce this AUP and protect the Service.

11. Reporting Abuse

If you believe ClearConverse services are being used in violation of this AUP, please report it promptly. Include relevant call or message details, timestamps, originating numbers, and any supporting evidence.

Report abuse to abuse@clearconverse.com or support@clearconverse.com. We investigate reports and cooperate with lawful requests from authorities.

12. Changes to This Policy

We may update this Acceptable Use Policy from time to time to reflect changes in law, carrier requirements, technology, or our practices. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page
  • Notify account contacts where appropriate
  • Display a notice within the Service when material

Your continued use of ClearConverse after changes take effect constitutes acceptance of the revised AUP.
